4/ Someone with a J.D. but who isn't barred isn't a lawyer for the purposes of representing clients. But it doesn't strike me as obviously wrong to describe that person as a lawyer in common parlance, where the description is probably being used to indicate that they are knowledgeable about the law.

3/ Lots of words have technical legal meanings and also somewhat different lay meanings. We might in ordinary discourse describe something as "murder" or "theft" or "treason" even if it wouldn't clear the legal bar for those crimes.
