One of the bigger problems the 2025 ruling has introduced is establishing that, instead of resolving equality cases based on trying to as best as possible integrate everyone's right to be treated humanely, we use philosophical debates about what someone's true legal essence is to decide rights.

As the 2011 guidance itself stated quite bluntly, it doesn't mean "men putting on lipstick" get to use the women's toilets either. It means dignity and humanity first, reject obvious rules hacking and work to integrate everyone's rights.

E.g. with the original inclusion of trans women in women's spaces, that doesn't imply we should exclude trans men who are not sufficiently far along in transition and don't feel safe using men's spaces etc. We shouldn't be ruling based on legal essence. We need to rule based on humanity and dignity.
