Tommy doesn’t think his highest allegiance should be to the US Constitution (which is a pretty weird idea anyway). He thinks the Constitution derives its legitimacy and force from acknowledging the pre-constitutional specialness of people like him. If it no longer does that he doesn’t care about it.
