There’s been a decades-long campaign to gut the National Environmental Policy Act, because it has led to actual limits on environmental harm by developers. It’s hard to see that happening if the permitting bill gets enacted. Feels like a death knell. scholarship.law.columbia.edu/cgi/viewcont...

Environmental litigators aren’t stopping the glut of natural gas fired infrastructure so we should take away the few tools that might help at least ameliorate the harms of that buildout & give ever more concessions to fossil fuels via NEPA exclusions is not the argument you think it is, @volts.wtf.

If those tools are doing nothing why is O&G so desperate to get rid of them? This is not some one off attempt, they've been doing this for years now.

I appreciated the replies from @janhasselman.bsky.social, an environmental litigator who has blocked fossil projects using tools that BAAJA would take off the table. I also encourage you to read this New York Law Journal article by @michaelgerrard.bsky.social, a law professor at Columbia.

I'm not a lawyer, so take my interpretations with a grain of salt, but I'll summarize a few points here from @michaelgerrard.bsky.social's article that stood out for me. 1. Tight timelines for NEPA review, without much new resourcing for additional agency staff to conduct reviews.
