I mean credit where credit is due: "If he wants to spend the summer arguing with a bin, I won't stop him" is top tier posting
Show PostThankfully @akuareindorfkc.bsky.social is on the case with the legal ‘analysis’ of FWS and the Code of Practice published by Ian Dunt. It makes some very bad mistakes about the law, including this one. And its failure to acknowledge women have rights under the Equality Act & ECHR too (oops!)
Show PostThe policy capture in SPS disregarding the legal framework was discussed in an article in Scottish Affairs a few years ago. Bizarre that a substantive policy review did not take place despite warnings from former governors, staff, and lawyers that this was untenable.
Show PostQuite. The judgment engages the unusual proposition that is missing from some argument that women have rights under the ECHR & legislation too. The judgment also indicates red line rules are ECHR compatible. This is not a shock, but anathema to some who assume proportionate becomes case by case
