Indeed but platforms claim not to be making editorial choices! So unless they chose to forfeit that claim they don’t get the benefit of that protection. If Zuck would like to argue he should not be investigated for making editorial choices I will support his argument.

congressional hearings are meant to inform public policy and ...certainly there is policy work that needs to be done here?? like they can certainly be called for adversarial reasons, but congress investigating something also isn't equivalent to other government bodies investigating something
