USG: when states depart from the default that implicates constl rights, then it raises different problems. it would open floodgates to states changing rules for other constl rights like speech.

A non-clown could say "I believe LCM prohibitions are unconstitutional and when the issue reaches the supreme court they will strike down this law." I believe they are wrong (at least on the first part) but it's not absurd to say. But saying the Court has already decided the issue is just a lie.
