It’s uncharged bc it postdates the complaint, so they can’t find that he did the UPL on it. They did find that it counted as holding out, which as a matter of law constitutes UPL. Once they find that it was misconduct, they don’t have to find anything else to hold that it’s aggravating.

The Court isn’t implying that any of his conduct isn’t egregious; they’re saying it doesn’t matter if it is, it’s all bad enough to warrant disbarment either way.
