But, yea, I doubt the dissenters in the birthright case will agree with that. In fact, they're all on record at one point or another effectively saying they believe AR bans are unconstitutional.

That is how lower courts have upheld AR bans under Bruen. They argue that technological advancements, like the development of semi-autos and "assault weapons," have led to mass shootings and that justifies looking at historical analogues with a wider lens.

It's possible. You already have 4 of the conservatives saying on record that they effectively think AR bans are unconstitutional. I don't see much reason to think Roberts and Barrett would go the other way. But you never do know.

I don't see anything in their previous opinions or oral arguments to suggest Roberts or Barrett would uphold an AR ban. But it is true they haven't specifically said anything on the issue, yet. So, there's still some ambiguity.
