They are trying to tell judges they don't matter an that the president is above the law. There's a few things I can say he wouldn't be above but I'd get arrested.

The DOJ's job now is explaining why the president's posts don't count as statements. Two days after their lawyers told a judge it was just "preliminary thought," Trump posted the floor plans. Hard to litigate when your own client is the star witness against you.
