I’ve been rereading Slaughter this morning — it’s perfectly illustrates the way the Court has enabled this presidential power grab and undermined the law in the process. Leave aside the many factual errors and misleading characterizations in the opinion. It fails to simple expound the law.
Show PostAll we get from the opinion is the repeated assertion of the need for presidential accountability through the electoral process — a vision of presidential democracy the Framers rejected and the Roberts Court’s voting rights opinions have crippled. Enough.
