This is bad too: "He has not explained why he waited for a year and a half (after the crime) to file his U visa petition with USCIS." 18 months is not an unusual delay. Many agencies won't even certify until the investigation is closed.

Feel fortunate to have helped two U visa applicants bond out of ICE jail in the last few months. This decision puts the kabosh on that possibility. The failure to raise the annual U cap says a lot about the importance and priority U visas are given

Screaming about this in my office this morning. It's an obscenity. A public interest in "expeditious enforcement of the immigration laws" outweighs a prima facie U visa? Why? Because we said so.
