Gil was a constant tinkerer and an energy democrat who believed in simplicity and accessibility of design. His campus lab was a haven of experimentation where getting the right answer was less important than learning by trying. He had a sharp sense of humor and absolutely no interest in status.

My read is that, if passed, the wind industry could seek to bring a claim; however, because "disparate treatment" requires a "substantial increase" in permitting delays relative to the most recent 5-year period (1402(a)(3)(A)), it's unclear how those statistics would shake out in the next few years.
