Show PostYou hear this in parents rights groups all the time. "How could they take my kids away if I was never convicted of a crime?" Because they had evidence against you, they just didn't want to traumatize your kid even more.
Show PostIt's pretty common for the courts to not pursue criminal charges because it's believed that making a child victim testify against a parental figure and undergo cross-examination would be even more traumatic to the child.
Show PostThere are *often* no criminal charges placed in these sorts of cases because the standard for removing kids from custody in family court is preponderance of the evidence or clear and convincing evidence, not beyond a reasonable doubt.
