What happens to Hillary & the Senate in 2020? If Hillary wins & Dems reclaim the Senate, Roe is safe for sure. If Hillary wins & the SCOTUS remains a court of 7, there is still a pro-Roe majority.
Show PostLet's assume Ginsburg dies at the sametime in this alternative world. Come the 2020 election the SCOTUS has two vacancies, 4 GOP & 3 Dem BUT since I assuming Kennedy is still on the court we have a pro-Roe majority on the SCOTUS.
Show PostWould Anthony Kennedy have resigned under President Hillary? I don't think so. Kennedy also was, at the end, pro-Roe. So for nearly 4 years of President Hillary, we have 4 GOP SCOTUS & 4 Dem SCOTUS plus the Scalia vacancy & one of the GOP SCOTUS is pro-choice Roe is safe
Show PostRoe was overturned because Trump appointed 3 new SCOTUS members during his term. If we game out being maximally pessimistic. The 51 GOP senators don't allow Hillary to appoint a replacement for Scalia. Let's assume Dems don't gain the senate in '18 & then Ginsburg. Still dies.
Show PostMcConnell absolutely would not have worked with Hillary on much of anything. Maybe--MAYBE--some good industrial policy like Biden's CHIPs Act & the Infrastructure bill could have passed, but honestly I think more likely he'd have treated her like Obama i.e. total opposition
