A federal judge recently said he’d overturn a conviction if it required jail time bc he viewed locking the defendant up at the MDC as excessively cruel. Cornish game hens! Not even in the same multiverse as reality.

To be clear, my point here is not to engage w this inanity on the merits. It’s to ask why we listen to Smith at all, if he is willing to make such facially ridiculous claims w a straight face.

3. How would this even work (which it obv can’t)? Evolutionary pathways (which take 100,000s of yrs, not 500) operate via reproduction. Did we lock up/execute enough young ppl in the 1500s to “weed out” “the impulsive”? Pre.pos.ter.ous. 4. “Crime gene” talk is utterly repulsive on its face.
