A danger with broad or dormant criminal laws is that it just takes one prosecutor or head of the executive to use them as a vindictive tool for political or personal motives. And the American system doesn't have any real check on doing so.

This is an untenable situation. It has made banking and security for dispensaries a long-term problem (although Congress helped some). An ill-intentioned President can use the continued criminalization of marijuana to selectively target enemies involved in the industry and they won't have recourse.

If the elections go as predicted in a couple weeks, I expect a narrative will form that Republicans lost a lot of seats through terrible campaign decisions like this ad and the Ramaswamy mess. That won't be true, but it might have the side benefit of ending the careers of some really awful people.
