Only SCOTUS decision today is in the conversion therapy case. Justice Gorsuch writing. The case is from the same sitting as Callais, which means now that only Justice Alito has not written for that sitting.
Show PostGorsuch's opinion for the court holds that Colorado's law is subject to strict scrutiny as applied to talk therapy. But Gorsuch does not actually run through the test here—he just strongly implies that when the lower court does, it'll be obligated to block the law's application to this plaintiff.
Show PostThis decision applies only to talk therapy, not forms of "conversion therapy" that involve physical interventions (which are really abuse). It does not strike down Colorado's law on its face. Actually, it does not invalidate anything—it just holds that this kind of law is subject to strict scrutiny.
Show PostFYI: I am going to stop summarizing Supreme Court decisions on here as they come down. One comment has been plucked out of context of all my reporting, misread, and used as the basis of a mean-spirited pile-on. I am not going to subject myself to this. If this was your goal, then congratulations.
Show PostHOW was this awful decision 8–1? Kagan's uncharacteristically enigmatic concurrence/explanation/quasi-apology makes it hard to tell. slate.com/news-and-pol...
