This was Schumer's baby. The Senate whip (either party's) has a specific function. The whip cajoles and strongarms party members to vote with leadership. The one person the Senate Minorioty Leader (or Majority) can count on is their whip. Schumer's is Dick Durbin, who voted with the Republicans.

You're missing the point. The pardon doesn't give him any "ways to wiggle out of the settlement." Even if the pardon had any effect on civil cases (it doesn't), there are only a few ways that you can "wiggle" out of a settlement. None of them apply here.
