It also seems kind of bad that the Justices's book deals are interfering with their ability to hear cases. This isn't just one Justice being recused out; this is the entire Court lacking the quorum to hear the case at all.

Notably, BMG bought into the lawsuit: it purchased the copyright interests at issue after the Fifth Circuit's mandate issued. The original defendants wouldn't have been affected by conflict.

I believe that by immediately petitioning for certiorari, BMG et al. gave up the oppotunity to move for rehearing or rehearing en banc. Oops.

It seems like at some point BMG's counsel should have realized that its corporate parent also owns Penguin Random House, which publishes books by Justices Barrett, Gorsuch, Jackson, and Sotomayor.
