As I read the article, it appears JC Penney was given permission to use Mackie's name by the Bob Mackie Design Group (of which Mackie is a shareholder). BMDG says it owns full rights to license the Mackie name. Mackie disputes that. Seems like Mackie SHOULD be suing BMDG rather than JCPenney.
