Clean Water Act reaches more than wetlands, it applies to point sources as well as "waters of the U.S." Clean Air Act certainly applies. ESA applies if listed species or designated habitat are onsite or nearby. NEPA applies if there's a federal permit, federal spending or use of federal lands.

Interesting and well explained! Do you forsee capacity factors changing? In UK, building incremental wind/solar has been displacing gas from baseload to backup roles. That dramatically reduced the CF of the gas fleet, ~ 80% down to 30%CF. But in years when demand increased, gas CF rebounded.
