In the short term, it means this specific attempt to cap indirects is toast. If NIH appeals, they’ll likely lose. But Congress can always change the law to cap rates (or give NIH more leeway to cap them), and the NIH can always try again down the line. So we’ll see. But it’s good news for now.

This has put immense pressure on grants staff, many of whom are worried about facing legal consequences for their actions. They are caught between following HHS directives not to issue some grants, and court orders (as per Mike Lauer’s memo) to start reissuing grants, I'm told.

Yes, they can challenge it, but I honestly doubt they will. Muskrump relies on that tidal wave of news coverage when they announce their ridiculous plans, but they rarely follow through on them because they're stopped. Then they quietly drop the efforts. It's like it's all for show or something.
