I think there is legal precedent that would afford him some sort of qualified immunity for protesting excessive workplace pottying, but already having been fired might be an important caveat that works against him.

Qualified Immunity amounts to state impunity. I will vote for whatever candidate pledges to abolish this absurd doctrine by statute.
