The murderer is the agent that places themself in front of the vehicle while it is reversing and draws their weapon. Which appears to have made the driver fear for their life and rightfully so.

If the driver had intended to hit the agent, the car would have still hit the agent. It only went to the right because the driver had swiveled the wheel to the right to avoid hitting the agent. This would have been clearly visible to the agent.
