They might still be copyright. It will be interesting to see whether AI infringing copyright in the software space is treated any different from ALL of the other spaces in which it is happening.

The received wisdom in the software industry is that you never patent your tools, because patents are public and it's better to keep your features private, even if they're legally unprotected. Oops

To be fair the AI sweatshops employees are living hell right now, I too would rather hurls myself out of a moving bus than hear a techbro sell me the very thing I'm painstakingly maintaining above water.
