Technically, you're right... But fanart is that grey area that usually receives no enforcement unless Devin was using fanart as their sole product/service or intentionally misleading customers. Some studios OK fanart. But the studio would still have to pay Devin if they did want to use the fanart.

Technically not how that works. OP still owns their art despite not owning the IP/Characters. Paramount wouldn't be able to use this art without OP's permission, even though they own the characters. IP law is complicated.
