    I also suspect that this is an area in which the perfect is the enemy of the good: Ending QI has been such a prominent focus among reformers that having *zero federal remedy at all* has received much less attention—and there may be votes for a remedy with QI but not enough without QI. We'll see.

    Kinda wonder, if the Supreme Court were to overturn Bivens entirely in Nielsen v. Wantanabe, could that combined with the new Congress help trigger legislation finally creating a statutory remedy?

    there's like. a really decent chance Annie Andrews starts a surprising number of fights with her Republican colleagues. a liberal white woman raised in Kentucky and Indiana who spent her adult life in South Carolina has probably been starting surprising numbers of fights her whole life
