Except now all these various people are asking LLMs what's the difference between a lawyer and an attorney, so models are now trying to figure out what is the difference and grasping at any straws they can find. Because why would all these people ask that unless there was a difference?

It might be dumber than all that. These things are really good* at picking up nuance in how the question is asked and "what's the difference between X and Y" to them implies there must be a difference so it's going to go all out proving** it. *no they aren't **you know what I mean
