He was bopped for it because it was misconduct, because by applying for the gig while unable to practice, he "impliedly held himself out as a person entitled to practice law." Naney at 195. I know you don't like it, but under CA law just using the title is holding out, and holding out is UPL.

Hell, other folks have been bopped for UPL just for *applying* to a GC job when they were ineligible to practice. In re Naney, 51 Cal. 3d 186, 195, 793 P.2d 54, 59 (1990).
