    A reminder that HUD's homeless count deliberately excludes vast numbers of people experiencing homelessness: families living doubled up with others or in extended-stay hotels and motels. There's an entire world of homelessness hidden from view, an entire population rendered statistically invisible.

    You could make a reasonable case WHCOS as currently constituted violates the appointments clause because they're not an inferior officer (they have no superior but POTUS) and so should require Senate confirmation as a principal. But the idea they're a non-officer I find wholly untenable.

    I think White House chief of staff is impeachable and it doesn't make much sense to say they're a mere non-officer employee when they run a whole large agency (EOP). But also to the degree it's arguable, it's solely up to the House and Senate to decide and their determination is nonjusticiable.
