That was the FTC's argument in the Media Matters case. "It's just a CID, what's wrong with that?" Judge noted that the CID (the equivalent of a subpoena) was retaliatory. You can argue that the FTC is not Congress, but they are both part of the gov't, both issuing subpoenas for "investigations."
