It's legal because people ignored them and pushed for it anyway. Newsom started marrying gay couples in 2004, and people went apeshit because it was "too soon." But it got the ball rolling instead of waiting for some mythical perfect time promoted by people who just didn't want to deal with it ever.

Unfortunately there are people who care about trans people having rights who are not trans people themselves and I’m sure that the number will suddenly grow exponentially post election when candidates have lost and you’re looking for someone to blame that isn’t the candidates themselves
