Woodward seems concerned that Judge Reyes is trying to catch him in a lie. Which, y'know. He should be.
Show PostWe have not heard from Plaintiffs yet. The reason for this hearing is to clear up apparent inconsistencies between DOJ's representations to the court and Trump's TS posts. Woodward's answers have been, essentially, that Trump's TS posts don't have legal relevance for Plaintiffs' ABA lawsuit.
Show PostTo recap: this hearing has been very contentious. DOJ's Stanely Woodward is being obstinate. Judge Reyes is quite obviously angry because she's pretty sure she's being lied to repeatedly. She started the hearing by quoting from the rules of professional conduct, specifically the duty of candor.
Show PostNot everyone is like this, but some people don't get loud when they are enraged, they get really terrifyingly quiet. In my opinion, that's the kind of quiet Judge Reyes was wearing when she abruptly said "we're taking a 15 minute break" just then.
Show PostJudge Reyes is stunned. "Are you kidding me right now? Come on." JR: no one at DOJ or DOI thought that at a hearing about whether a plan existed they should disclose that there was a plan in the works? Woodward: deliberative process privilege.
