DOJ has still filed nothing at the Ninth Circuit, which, normally, would mean nothing. I am surprised in this instance, since they had asked for a ruling on Tuesday and knew it was coming on Wednesday, that they were not nearly ready to file — w any necessary changes once they got Carter's opinion.

To be clear, they lose here; Bennett and Sanchez already said as much. DOJ will be angling to get to SCOTUS by end-of-day Friday, I suspect. This is all horribly embarrassing, to be just as clear, for the Justice Department and anyone left there who thinks they are advancing justice.
