I think the search engine theory makes sense, since the most confounding case of takedowns was when they deleted all the mario games off of gamejolt (iirc). That wasn't really competing with any of their games, but it makes sense if it was the first result when looking up "new mario game" or such

from what I notice nintendo only really seems to get mad if your fan project is showing up when people start searching for their games. like I see AM2R and Metroid Prime Origins brought up all the time but no one seems to mention Metroid planets being ok (taking it a step further and going planets)

I suspect there are a lot of people whose only exposure to fangames existing at all were the few high-profile takedowns about a decade ago, and that's the only takeaway they ever took from it. It's frustrating to see the Sonic scene go on and the side I chose just faded out after that

I still believe that the insufferable responses to Nintendo fan projects did more damage to the fan scene than Nintendo's boneheaded copyright practices ever did. Only ever getting DMCA jokes in response to making something is miserable and demotivating, not mention scares new faces away
