That would change if the courts and/or the Senate eventually decide the election has failed altogether and nobody won, then you have a vacancy for appointment and special election. But not so long as there's a possible regular election result still pending.
Show PostNo, if an election genuinely isn't resolved yet by Jan 3 because of ongoing litigation, the seat would go unfilled until there is an official winner. This happened to Al Franken until he was finally seated after a protracted recount. It wouldn't count as a vacancy to be filled by appointment.
Show PostThe canvass (i.e., official final vote totals) is certified in late November and the governor has no role in that. Dunleavy refusing to sign it immediately would delay the certificate sent to the secretary of the Senate by a few days at most. Honestly wouldn't even be worth suing him over.
Show PostThere are other reasons this is nonsense and remedies available if he tries, but on top of everything else: Dunleavy's term as governor ends on Dec 7. Even if he flat-out refused to sign the certificate before leaving office, it isn't needed until Jan 3. Jonathan Kreiss-Tomkins could simply do it.
Show PostThe reason that you know the army isn't actively planning anything that would require digging temporary graves is because they have the time to do this. If they were planning something, they'd be too busy planning and training that to do this.
