I would imagine Judge Reyes is going to go back to the transcript from the prior hearing since Woodward now says the plan has been in process for weeks to see if that is inconsistent with a prior representation or the declarations.

Judge Reyes is stunned. "Are you kidding me right now? Come on." JR: no one at DOJ or DOI thought that at a hearing about whether a plan existed they should disclose that there was a plan in the works? Woodward: deliberative process privilege.
